Emergency Marine Solutions, LLC

This Marine Service Authorization and Repair Agreement ("Agreement") is entered into between Emergency Marine Solutions, LLC ("Company") and the Customer identified below. 1. AUTHORIZATION TO PERFORM SERVICES The Customer authorizes Emergency Marine Solutions, LLC to perform diagnostic inspection, maintenance, and/or repair services on the vessel described herein. No work shall commence without this signed authorization. 2. SERVICE CALL FEE A non-refundable Service Call / Dispatch Fee is due at the time of scheduling to secure the appointment and dispatch a certified marine technician to the Customer's vessel location. 3. LABOR RATE Labor is billed at the stated Hourly Rate per technician, per hour. Time begins when the technician arrives on-site and ends when the technician departs the property. Diagnostic work is billed at the same hourly rate until the issue is properly identified. 4. PARTS & MATERIALS Parts, fluids, and materials required for the repair are additional and will be quoted separately. Whenever possible, the Customer will be notified and approval obtained before ordering parts. Parts are billed at retail cost plus applicable handling fees. 5. ESTIMATES & APPROVALS If additional repairs are discovered beyond the scope of initial authorization, the Company will attempt to contact the Customer for approval before proceeding. If the Customer cannot be reached within a reasonable time frame, minor repairs necessary for safety may proceed at the Company's discretion. 6. VESSEL ACCESS The Customer is responsible for ensuring the vessel is accessible, in safe operational condition, and that the technician can safely work aboard. If the technician is unable to access the vessel upon arrival for any reason, the Service Call Fee will still apply. 7. PAYMENT TERMS All invoices are due upon receipt unless otherwise agreed in writing. Unpaid balances after 30 days may be subject to a 1.5% monthly finance charge. The Customer agrees to pay all reasonable collection costs, including attorney's fees, in the event of non-payment. 8. WARRANTIES & LIABILITY Emergency Marine Solutions, LLC warrants its labor for a period of 30 days from date of service. Parts carry the manufacturer's warranty only. The Company is not liable for pre-existing conditions, hidden defects, or failures unrelated to the service performed. Maximum liability shall not exceed the amount paid for the specific service. 9. ENVIRONMENTAL & SAFETY COMPLIANCE The Customer acknowledges that certain repairs may require the vessel to be out of the water or may generate waste materials. The Company will handle all waste in compliance with applicable federal, state, and local environmental regulations. Any additional costs for hazardous material disposal will be itemized on the final invoice. 10. FORCE MAJEURE Emergency Marine Solutions, LLC is not responsible for delays caused by marina restrictions, weather conditions, supplier delays, parts availability, or other circumstances beyond our control. 11. GOVERNING LAW This Agreement shall be governed by the laws of the State of Florida. Any disputes arising from this Agreement shall be resolved in Hillsborough County, Florida. 12. ENTIRE AGREEMENT This document constitutes the entire agreement between the parties regarding the described services. Any modifications must be in writing and signed by both parties.
